General terms and conditions

Article 1 - Object

The general terms and conditions define the rights and obligations of the applicable parties to the sales made by SAS OCEAN GOODS on the products sold on their internet site www.oceanclock.com.

Each order of a product from the OCEAN CLOCK online store is conditional on the unreserved acceptance by the customer of these terms and conditions.

The products are for sale in the following geographical territories: Mainland France, Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, Portugal, United Kingdom, Ireland, Denmark, Sweden, Switzerland, Finland, Greece, Iceland, Norway, Australia, Canada, South Korea and the United States.

SAS OCEAN GOODS reserves the right to modify these terms and conditions at any time.

The Customer recognises, upon confirmation of their order, that they have read the terms and conditions on the site as well as the conditions on this page which constitute the entirety of the online terms and conditions. Consequently, the placing of the order by the customer should be considered as full and complete acceptance of these conditions, which are the only ones applicable to the contract thus concluded.

Article 3 - Products on oceanclock.com

In accordance with article L. 111-1 of the Consumer Code, the purchaser is able, before ordering, to read the main features of the products they wish to purchase on the site www.oceanclock.com.

The products are available at the prices and conditions displayed on the site www.oceanclock.com, subject to availability.

In the case of one of the products being out of stock, an email will be sent to alert the customer. SAS OCEAN GOODS reserves the right to propose a similar product or to cancel the unavailable product from the order and reimburse the customer.

The photographs and descriptions of the products offered for sale are for information use only and do not bind the seller.

Article 4 - Prices

The prices displayed on the site www.oceanclock.com indicated in Euros are those applicable at the moment of confirmation of the customer's order.

The delivery fees are payable by the customer, except in particular circumstances when www.oceanclock.com will take responsibility for them. The places, conditions and amounts of the handling and delivery fees are displayed before the confirmation of your order.

The total price indicated in the review of your order is the final price. This price includes the total price of the order with the detail of each product and the possible shipping costs.

All prices indicated include all taxes, including VAT.

The prices of these products can be modified by SAS OCEAN GOODS at any time. The purchaser will be alerted to any modification before order confirmation.

Article 5 - Processing your order

The recording of an order on the shop of the site www.oceanclock.com and its validation by the customer occurs at the moment when the customer clicks on the choice of payment method on the page "Payment".

Orders are not definitive until they have been confirmed by payment from the customer. An email will be sent to the customer to confirm.

Article 6 - Methods of payment

Payment must be made by the customer during the order confirmation process. All orders are payable in Euros. SAS OCEAN GOODS reserves the right to suspend or cancel any order and/or delivery, regardless of its progress, in case of non-payment of the full amount due by the customer or in case of a problem with the payment.

To pay for your order online, there are several payment methods available:

- National debit card, Visa, Mastercard.
The site www.oceanclock.com is equipped with the PAYPLUG secure payment system.
Oceanclock.com can also handle Paypal payments.
Paypal is a secure payment system that allows you to send and receive electronic money online.
The sale is only considered final when payment has been confirmed remotely by Payplug or when Paypal validates the sale from SAS OCEAN GOODS.

Article 7 - Delivery conditions

The products will be sent to the address indicated by the customer on the order form, in mainland France.
The receipts will be sent to the email address provided by the customer when their account was created.
If any of the below procedures are not followed, no complaint from the customer will be accepted.
Order processing takes place from Monday to Friday, except public holidays.
The delivery times are for information use only and the customer cannot claim damages due to late delivery or cancel the order.
In any case, delivery within the agreed time can only take place if the purchaser has fulfilled all obligations to us, regardless of the cause of the eventual error.
The order will be fulfilled within 3 days at the latest from the day following that when the customer's order was definitively confirmed (payment method received and order verification procedure completed).

In case the product ordered is unavailable, especially when this is due to a problem with our supplies, the customer will be informed as soon as possible and will have the option to cancel their order. The customer will have the choice of asking for either a reimbursement, if necessary, within 30 days of it being received by us, or an exchange with a product of similar characteristics and price, if SAS OCEAN GOODS is able to obtain it.

The customer is responsible for the exhaustiveness and the conformity of the information (delivery address, pick-up point, bank details, delivery conditions etc.) confirmed when the order is placed. SAS OCEAN GOODS cannot be held responsible for any problems delivering the product.

The delivery time indicated on the order confirmation is given for information use only and is not a guarantee.

Consequently, any reasonable late delivery of a product cannot lead to the purchaser claiming damages or cancelling the order.  All transport risk is assumed by the customer.

In case of missing or damaged merchandise, the purchaser must formulate the necessary complaint on the order form upon receiving the merchandise. This complaint must be sent in writing within 5 days of the original delivery by registered post with acknowledgment of receipt.

It is the responsiblity of the recipient to verify the state of the parcel in the presence of the delivery person. Any anomaly during reception must be brought to the attention of the carrier in order to initiate a reimbursement procedure for it.

In accordance with the provisions in article L. 121-20-3 in the Consumer Code, the ordered products are sent at the earliest opportunity from the day following that when the Customer placed the order, on condition that the full payment has been received.

An investigation into the chosen carrier can last up to 21 business days. If, during this time, the product is found, it will be immediately redirected to the place of delivery indicated in the order form.

On the other hand, if the product is not found at the end of 21 days of investigation, the order will be resent to the Customer without any additional fees.

In the event that the product ordered is no longer available, the following provisions shall apply. In case of product exchange, the delivery costs will be charged to the customer.

Article 8 - Return conditions

In accordance with article L. 121-20 of the Consumer Code, the customer has a period of 14 days from the date of reception to return the ordered products for reimbursement at their own expense.

All return requests should be take place over email using the address [email protected].

The payment method used for reimbursement will be the same as the one used by the customer for the initial order. However, we are able to consult the customer to propose them a different payment method for reimbursement. The customer is free to accept this or not.

The products should be returned to the following address: OCEAN CLOCK, 219 Avenue de Pedebert, 40150 SOORTS HOSSEGOR. The product should be in perfect condition for resale, in its original state (packaging, accessories, instructions etc.), sealed and accompanied by the name of the customer, their address as well as the date and order number.

Article 9 - Transfer of product ownership

SAS OCEAN GOODS retains full and complete ownership of the products sold until full payment of the price, in principle, fees and taxes included; however, the risks are borne by the purchaser as from the delivery of the product to Colissimo.

Article 10 - Intellectual property and copyright

All elements of the site www.oceanclock.com, whether they be visual or audio, including the underlying technology, are protected by copyright law. When accessing the site www.oceanclock.com, the customer is prohibited from copying or downloading all or part of its contents, without the prior and express permission of Ocean Clock. A user who has a personal Internet site is allowed to include a simple link directing to the homepage of the site www.oceanclock.com.

In this particular case, it will not be an implicit contract of affiliation. On the other hand, all hypertext links directing to the site and using framing techniques or in-line linking is strictly prohibited. In any case, any link, even tacitly authorised, should be removed on request by SAS OCEAN GOODS.

Ocean clock® is a registered trademark. To this end, all contents of its online store belong to it. Copyright protection and the provisions of the Intellectual Property Code relating to trademarks prohibit copying or reproducing in any way whatsoever the models presented by Ocean clock®, which holds all the rights. Therefore, any minor manufacture or processing into a similar product for commercial or personal purposes is prohibited. Infringement of these rights would constitute a violation of copyright and intellectual property rights and would subject the responsible user to the criminal and civil penalties provided for by the applicable legislation in this area.

Article 11 - Responsibility

The seller's liability may not be invoked if the non-execution or delay in the execution of one of its obligations described in these terms and conditions results from a case of force majeure.

As such, force majeure refers to any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

The seller's liability may also not be invoked in the event of a disruption or total or partial strike of the postal services.

Article 12 - Data Protection Act

In accordance with the Data Protection Act of the 6th January 1978, you have the right to access, modify and delete any data that concerns you. You can exercise this right by contacting us by email at [email protected].

Article 13 - Partial invalidity 

If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.

Article 14 - Non-waiver provision

The fact that one of the parties does not claim a breach by the other party of any of the obligations referred to in these general terms and conditions of sale cannot be interpreted in the future as a waiver of the obligation in question.
